ART KID – Terms and Conditions

These Terms and Conditions apply to courses, workshops and other activities organised by ART KID and purchased through the ART KID website or directly from ART KID. Please read them carefully before booking.
 

1. About ART KID

2. Scope of These Terms

These Terms apply to paid courses, workshops and other activities organised by ART KID unless separate conditions are expressly provided for a particular activity.

By making a booking, the parent or legal guardian confirms that they:

• are at least 18 years old;

• have authority to register the child;

• have read and accepted these Terms;

• have provided accurate and complete information.

The version of the Terms accepted at the time of booking applies to that booking. Later changes do not apply retrospectively.
 

3. Course Information

The description of each course or activity specifies, where applicable: the age range; dates and times; the venue or general location; the teaching language; the number and duration of sessions; the price; included materials; and any particular participation requirements.

Parents and guardians are responsible for checking that the selected activity suits the child's age and availability before booking.

ART KID may make minor adjustments to lesson content or the order of activities where this supports the needs of the group and does not substantially change the nature of the course.
 

4. Booking and Confirmation

A place is reserved only when: (1) the required registration information has been submitted; (2) payment (or the first instalment, where instalments are offered) has been received; and (3) ART KID has issued a booking confirmation by email.

The parent or guardian must check the confirmation and notify ART KID promptly of any errors.

Places are subject to availability. ART KID may refuse or cancel a booking before the course begins if:

• the child does not meet the stated age requirement;

• incorrect or materially incomplete information has been provided;

• ART KID reasonably determines, after discussion with the parent or guardian, that it cannot provide the support required for the child's safe participation in the group format;

• payment has not been completed.

If ART KID refuses or cancels a booking under this section, any course fee already paid will be refunded in full. ART KID may withhold a refund only where payment was never completed or where there are reasonable grounds to suspect fraud.

5. Prices and Payment

The applicable price is displayed before payment. Unless stated otherwise:

• the price covers the complete course or activity described at the time of booking;

• standard art materials are included;

• transport, food and personal expenses are not included;

• payment is due in full at the time of booking.

Instalments. Where ART KID offers payment in instalments, the instalment schedule is stated before payment. All instalments remain due for a confirmed booking, and the cancellation and refund rules in Section 6 apply to the total course fee, not to individual instalments.

Priority list. Priority-list prices apply only to bookings completed by the stated deadline. Joining the priority list is free, creates no obligation to register, and does not guarantee a place.

Discounts and promotional offers cannot be combined unless ART KID expressly confirms otherwise. Payment-processing fees charged to ART KID are included in the displayed price; no additional payment fee will be charged unless clearly disclosed before payment.
ART KID currently operates under the Luxembourg small-enterprise VAT exemption regime in accordance with Article 57 of the Luxembourg VAT Law. VAT is therefore not charged on the prices stated, unless ART KID’s VAT status changes in the future.
 

6. Cancellation and Refunds
 

6.0 Relationship with statutory rights
 

If mandatory consumer law grants the purchaser a right that is more favourable than the rights described in this Section, that statutory right prevails. Nothing in this Section limits or replaces it.
 

6.1 Statutory right of withdrawal (distance bookings)

For bookings made online or otherwise at a distance, the purchaser has the right to withdraw from the contract within 14 calendar days from the day the booking is confirmed, without giving any reason and without penalty.

To exercise this right, the purchaser must notify ART KID of the decision to withdraw before the period expires, by an unambiguous written statement (for example by email to hello@artkid.lu) or by using the model withdrawal form provided at checkout and in the booking confirmation.

If the purchaser withdraws, ART KID will refund all payments received, using the same payment method as the original transaction, no later than 14 calendar days after being informed of the withdrawal.

Courses starting within the withdrawal period. If the first session takes place before the 14-day period expires, ART KID will ask the purchaser to expressly request that the course begin during the withdrawal period via email. If the purchaser makes this request and later withdraws before the period expires, ART KID will deduct a proportionate amount for the sessions already provided and refund the remainder.

6.2 Extended goodwill cancellation – until 5 days before the course

In addition to the statutory right, the purchaser may cancel the booking and receive a full refund if written notice is received no later than 5 calendar days before the scheduled start of the first session, even after the 14-day statutory period has expired. 
 

6.3 Late cancellation

If cancellation is received less than 5 calendar days before the first session and no statutory right applies (Section 6.0), the course fee is non-refundable unless a replacement participant takes the place.

The family may propose a replacement participant. The replacement child must meet the stated age requirements, provide all required registration and emergency information, be accepted by ART KID, and pay the applicable course fee in full. The refund to the original purchaser is issued once the replacement participant's payment has been received. ART KID may also offer the place to its waiting list but cannot guarantee a replacement will be found.
 

6.4 How to cancel

Cancellation requests must be sent to hello@artkid.lu and include the purchaser's name, the child's name, the course, and the booking or order number if available. The date ART KID receives the written request determines whether a deadline is met. Refunds are issued to the original payment method within 14 calendar days.
 

7. Missed Sessions

A course booking reserves a place for the complete course. No refund, credit or replacement session is provided if a child misses a session for reasons personal to the participant (including illness, travel, or scheduling conflicts). ART KID will, on request, provide the materials for the missed session so the child can continue their Case File at home.

In exceptional circumstances, ART KID may offer an alternative arrangement at its discretion, but no alternative can be guaranteed. Mandatory rights arising from public-health rules or other legal requirements are unaffected.
 

8. Group Size

Unless otherwise stated, an Art Detectives course runs with a minimum of 4 and a maximum of 10 children. ART KID may choose to run a course with fewer than 4 participants but is not obliged to.

If the minimum is not reached and ART KID decides not to run the course, families will be informed as soon as reasonably possible, normally no later than 5 calendar days before the first session, and all course fees will be refunded in full.

ART KID is not responsible for additional costs incurred by families (transport, accommodation, alternative childcare), except where liability cannot legally be excluded.
 

9. Cancellation of the Complete Course by ART KID

If ART KID cancels the complete course before it begins, the purchaser receives a full refund. If ART KID has to discontinue the course after it has begun, the purchaser receives a proportional refund for the sessions not provided. Refunds are made to the original payment method within 14 calendar days.
 

10. Cancellation or Rescheduling of a Session by ART KID

If ART KID cannot provide an individual session as scheduled, it will first make reasonable efforts to arrange a replacement session and will communicate the replacement date within a reasonable time.

If a session is moved and the child cannot attend the replacement session, the purchaser may request a refund of the proportion of the course price allocated to that session (for a five-session course, normally one fifth). If ART KID cannot provide a replacement session, that proportion is refunded automatically. Refunds under this section are made within 14 calendar days.

The cancellation or rescheduling of one session does not entitle the participant to cancel or receive a refund for sessions provided as originally agreed.
 

11. Change of Venue

ART KID may move a session to another suitable venue within Luxembourg City when reasonably necessary; families will be informed as soon as possible. Such a change does not entitle the participant to a refund, provided the date, time and essential course format remain unchanged.

If a session is moved outside Luxembourg City and the child cannot attend as a result, the purchaser may cancel the affected session and receive a proportional refund (normally one fifth for a five-session course). If the entire course is moved outside Luxembourg City before it begins, the purchaser may cancel and receive a full refund; if remaining sessions are moved after the course has begun, the purchaser may cancel the unused sessions and receive a proportional refund.
 

12. Events Outside ART KID's Reasonable Control

A session may need to be cancelled or rescheduled because of circumstances outside ART KID's reasonable control, including sudden illness or emergency, unsafe weather, unexpected venue unavailability, interruption of transport or essential services, official restrictions, or another event that could not reasonably have been prevented.

In such cases ART KID will first attempt to provide a replacement session, normally within the course period or within 14 days after its scheduled end. If no replacement session can be provided, the affected session is refunded proportionally. Nothing in this section excludes any liability or consumer right that cannot legally be excluded.
 

13. Health, Allergies and Additional Needs

The parent or guardian must provide accurate and relevant information concerning allergies, medical conditions, disabilities or additional support needs, medication relevant to participation, and any other circumstance affecting the child's safety or participation – before the first session, and updated if circumstances change.

Providing additional-needs information does not automatically prevent participation. ART KID will discuss reasonable arrangements with the parent or guardian. However, ART KID may conclude that it cannot safely provide the level of individual supervision or specialised support required within the group format; where possible, this will be discussed with the parent or guardian before the course begins.

Medication. ART KID does not administer medication. If a child requires medication that may need to be taken or administered during a session (including emergency medication such as an adrenaline auto-injector), the parent or guardian must discuss this with ART KID before booking so that a safe arrangement can be agreed or, if none is possible, the booking declined and refunded.

14. Emergencies and First Aid

The parent or guardian must provide an emergency telephone number at which an authorised adult can be reached during sessions.

The organiser holds a current first-aid certificate (16-hour course). In an emergency, ART KID may provide basic first aid within the limits of that training, contact the parent, guardian or emergency contact, and contact emergency services (112) when reasonably considered necessary.
 

15. Arrival and Collection

The child must be handed directly to the ART KID teacher or authorised assistant at the start of the session; children must not be left alone outside the venue. ART KID's supervision begins when the child's arrival has been acknowledged by the teacher or authorised assistant.

At the end of the session, the child will only be released to the parent or legal guardian, an adult authorised in advance by the parent or guardian, or under another arrangement expressly agreed in writing. Independent departure is not permitted: children will not be released to leave alone, unless specifically discussed and agreed with the parent or guardian.

The parent or authorised adult must collect the child promptly at the stated finishing time. If collection is late, ART KID will contact the parent, guardian and emergency contact; the child remains supervised until a safe collection is confirmed.

16. Behaviour and Safe Participation

ART KID aims to provide a respectful, inclusive and safe environment. Children are expected to follow reasonable safety instructions and avoid behaviour creating a serious risk to themselves, others, staff or property.

If difficulties arise, ART KID will normally: (1) support the child within the session; (2) discuss the situation with the parent or guardian; (3) consider reasonable adjustments or another appropriate solution.

In the case of serious or repeated unsafe behaviour, ART KID may ask the parent or guardian to collect the child and may suspend or end the child's participation.

If ART KID ends a child's participation under this section, the parent or guardian will receive a proportional refund for the sessions not yet provided, unless participation was ended because of serious deliberate misconduct endangering others after at least one documented warning and discussion with the parent or guardian.

Nothing in this section permits discrimination on the basis of disability or another protected characteristic.

17. Clothing, Materials and Personal Belongings

Activities may involve paint, ink, glue, clay and other materials that may stain. Children should attend in suitable clothing that may become marked. ART KID takes reasonable precautions but cannot guarantee that stains can be prevented or removed. Valuable or unnecessary items should not be brought to sessions. ART KID is not responsible for ordinary loss of or damage to personal belongings unless caused by ART KID's negligence or where liability cannot legally be excluded.
 

18. Photography and Video

Photography and video are not required for participation. ART KID requests separate, optional consent before using identifiable images or recordings of a child for promotional, website, social-media or other external purposes. Refusing consent does not affect participation. Consent may be withdrawn for future use by contacting ART KID in writing; withdrawal does not necessarily affect material lawfully published before withdrawal.

19. Children's Artwork and ART KID Materials

Physical artworks created by the child belong to the child. Course presentations, activity sheets, teaching resources, graphics and other materials created by ART KID remain ART KID's intellectual property (or that of their rights holders). ART KID materials may be used by the participating family for personal, non-commercial purposes only.
 

20. Liability

ART KID will take reasonable care in organising and supervising its activities. Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, any liability that cannot legally be excluded or limited, or any mandatory consumer right.

To the extent permitted by law, ART KID is not responsible for indirect or consequential expenses (such as transport, alternative childcare or loss of personal time) resulting from a cancellation or schedule change.

21. Personal Data

ART KID processes personal data in accordance with its Privacy Policy. Personal information may be used for processing and administering bookings; communicating with parents and guardians; maintaining emergency and attendance records; protecting children's health and safety; and meeting legal, accounting and insurance obligations. Only information reasonably necessary for these purposes is collected.

22. Complaints

Questions or complaints should first be sent to hello@artkid.lu, including the purchaser's name, the child's name, the relevant activity and a description of the issue. ART KID will acknowledge or respond within 7 working days where reasonably possible and will attempt to resolve the matter fairly.
